A doctor is performing an appendectomy on a patient in the hospital where the doctor has hospital privileges. When the operation is over, the patient is turned over to the care of an experienced nurse who is an employee of the hospital and assisted the doctor during surgery, and she is responsible for the patient�s care overnight. When the patient awoke the next morning, he realized that he had injured his eye with his fingernail during the night. The patient sued the doctor claimed that he had been under the defendant�s control all night. Is the doctor liable for the injury to the patient? Why, or why not?
